Court of Appeal has dismissed an application by Chief Justice of Nigeria (CJN) Justice Walter Onnoghen to stay proceedings in the charge against him before the Code of Conduct Tribunal (CCT).
Justice Abdul Aboki of a 3-man justice panel, said in view of the provision of Section 306 of the Administration of Criminal Justice Act (ACJA), it lacked the power to stay proceedings in criminal cases.
Counsel to the CJN, Adegboyega Awomolo had earlier filed an appeal challenging the power of the CCT in hearing the trial.
Consequently, the CCT may now proceed with the hearing of the charges against the CJN.
The court adjourned to 4th February for hearing.
